Recently released survey results from the recent Canadian Bar Association research into use of retainer or engagement letters reveal the following perceived benefits of using an engagement letter:

  • Control or manage lawyer/client expectations about fees and work to be done (90%)

  • Avoid billing disputes (80%)

  • Improve lawyer/client relations (65%)

  • Avoid conflicts of interest (51%)

  • Avoid a law society complaint (49%)

  • Avoid a malpractice claim (39%)

Based on these results, use of engagement letters seems to be a “win-win” approach for both clients and their lawyers.
