CLIA Loss Prevention Repository: Limitation Periods/Time Management

Missed limitation periods continues to be one of the most common claims areas for CLIA Subscriber jurisdictions. Some reasons for missing a limitation period are inadequate office systems, human error and applying the wrong legislation. To help, we’ve compiled resources developed by our Subscribers and Partners in our Loss Prevention Repository.

Found under the main topic Common Claims Areas, Limitation Periods/Time Management contains numerous tips for avoiding missed limitation periods and better managing deadlines. Resources include:

  • Roundup: Avoiding Missed Limitation Periods (CLIA): A compilation of jurisdiction-specific resources and guidance no matter your jurisdiction.

  • Roundup: Time Management Tips: Human error and inadequate office systems are two of the reasons lawyers miss deadlines, including limitation periods. Improving time management skills can help. The Avoid a Claim blog published an outstanding series to help improve time management skills: Time Management Tips Tuesday.  See this post for a compilation of these tips to help you better manage your time, your practice and avoid missed deadlines.

  • Dear Diary (CLIA): A lawyer’s diary system can be a critical tool for organization and practice management. While we are encouraged from a very early point in practice, usually during articling, to begin using a diary system to track our work, many young lawyers find themselves unsure of what to track in their diary, why it is so important, and what type of diary system to implement for their practice. See this post in the “New Lawyer’s Guide to Avoiding Mistakes” series by Kelsey Barnes for the what, the why and the method.

  • Limitations and Deadlines (LIF): A compilation of useful resources from the Lawyers Indemnity Fund.

  • Missed Limitation – With the Best Diary System in the World (LIF): In this short video, Greg Sexton, Claims Counsel for Lawyers Indemnity Fund, provides tips for lawyers on how to prevent missed limitations and deadlines by adopting simple practices and ensuring their staff adhere to them.

  • Tips for Managing Deadlines (LAWPRO): Missed deadlines are a major source of malpractice claims. Lawyers sometimes fail to determine the limitation period on a matter or fail to properly calendar it, miss other deadlines or fail to act when they arise. LAWPRO provides six tips to avoid these claims.

  • Dangers Leading to Missed Limitation Periods (LSNL): Confirming the filing deadline as soon as you open your file, properly diarizing the date, as well as filing the Statement of Claim well in advance of the limitation date can help avoid a claim being filed against you. See this Loss Prevention Tip from the Law Society of Newfoundland & Labrador for dangers you should be aware of in your practice that can lead to a limitation period slipping between the cracks.

  • Time Management/Missed Limitations (LIANS): No matter how carefully you plan it, your day will still only have 24 hours in it.  Given the ever-increasing demands on our time, taking steps to effectively manage our time and use it wisely are very important. The Lawyers’ Insurance Association of Nova Scotia provides useful tips to better manage your time and avoid claims.
